Age requirements

You must be at least 16 years old to create an account or use WhosYourPoca. You must be at least 18 years old to participate in raffles, use wallet credits, request redemptions, receive prizes, or submit shipping information for prize fulfillment. By using the service, you confirm that you meet the applicable age requirement for the features you use.

Accounts and collector profiles

You are responsible for your account activity and for keeping login details secure. Public profile fields, collection pages, wishlists, biases, and favorite groups should reflect content you are comfortable sharing.

Catalog and discovery tools

We provide curated catalog information and organizational tools, but do not guarantee photocard availability, pricing accuracy, authenticity verification, or successful transactions on third-party websites.

Collections, wishlists and contributions

Contributions may be reviewed, edited, accepted, rejected, or removed to protect catalog quality and community safety. Only upload or submit content that you created, have permission to share, or reasonably believe may be used for cataloging, discovery, review, identification, or reporting. Do not upload private personal information about other people, malicious files, or content that violates another person's rights.

Intellectual property and user content

The platform displays content submitted by collectors and sourced from third parties. WhosYourPoca does not own the intellectual property of any photocard, group or member name, album artwork, or related trademark — these remain the property of the original rightsholders, typically the artists' record labels and entertainment companies. Contributors who upload photographs or scans of photocards do not acquire copyright either; their submissions are considered derivative works of copyrighted source material, contributed solely for cataloging, discovery, and identification purposes. WhosYourPoca assumes no responsibility for the accuracy, legality, or reliability of user-contributed or third-party content.

Rightsholder takedowns

Rightsholders may request removal of any material at any time. If the legitimate copyright owner asks us to remove content, we will take it down promptly, regardless of whether it was originally contributed by a user — the rightful owner always takes precedence over the contributor. Takedown requests can be sent to hello@whosyourpoca.com with a description of the material, where it appears on the site, and confirmation of authority to act on behalf of the rightsholder.

Marketplace links and third-party services

WhosYourPoca surfaces marketplace and store information to help collectors identify and discover photocards. Our relationship with these third parties is strictly informational.

• Marketplace listings — surfaced from external services. We do not control listings, prices, seller behavior, checkout flows, shipping, refunds, or marketplace availability.
• No commercial intermediation — WhosYourPoca is not a seller, reseller, broker, or intermediary. Purchases, exchanges, and other interactions with third parties are carried out solely at your own responsibility.
• Store names and logos — displayed in the catalog to identify the origin of photocards (for example, retailer-exclusive or pre-order benefits tied to a specific store or release period). This is nominative fair use for identification purposes only and does not imply partnership, endorsement, sponsorship, or any commercial relationship. All store names and logos remain the property of their respective trademark owners and will be removed promptly on rightsholder request.

Referral raffle and prize fulfillment

WhosYourPoca occasionally runs a referral raffle in which collectors can win photocards as a prize. Because the prize is offered free of charge and sourced from third-party stores, the following terms apply:

• Photocard sourcing — winners submit links to photocards available on third-party stores. WhosYourPoca may currently show a preference for a specific store for operational simplicity, but is not associated with, sponsored by, or partnered with any third-party store. The store sells the underlying photocard; WhosYourPoca purchases the prize as a gift on the winner's behalf.
• Shipping — winners choose between tracked and untracked shipping at the time of submission. Untracked shipments rely on standard postal delivery, which provides no carrier-confirmed proof of arrival. Shipping is provided worldwide.
• Limitation of responsibility — WhosYourPoca is not legally responsible for delays, damaged packages, customs handling, or for the authenticity, condition, or quality of photocards purchased from third-party stores. We are also not responsible for lost packages, particularly when shipped without tracking — choosing untracked delivery means accepting the risk that the carrier provides no proof of arrival. Because the prize is a gift and no payment is made by the winner, no warranty, refund, or replacement is offered. In case of an issue, winners may contact us at hello@whosyourpoca.com and we will see what we can do as a courtesy, without any legal obligation. Nothing in this section limits our liability for gross negligence, intent, or any liability that cannot be excluded under applicable mandatory consumer protection law.
• Address use — recipient name and shipping address are collected only when you win a raffle, used solely to fulfill the prize, and deleted within 30 days of confirmed delivery. See the Privacy Policy for full retention details.
• Eligibility — open worldwide to collectors aged 18 or older. The WhosYourPoca operator, anyone helping operate the raffle, and their immediate families are not eligible. Entries must be unique and not generated by automated means.

Acceptable use

Do not upload harmful content, impersonate others, abuse referral or reward systems, attempt unauthorized access, scrape protected areas, or use the product in ways that degrade service reliability.

Limitation of liability

To the extent permitted by law, WhosYourPoca is not liable for any of the following:

• Errors or inaccuracies in third-party content.
• Changes in availability or pricing on external websites.
• Damages resulting from interactions with third parties.
• Temporary unavailability or technical interruptions of the service.
